At Acosta Law Firm, we focus on estate planning, elder law, and closely related practice areas. Our true focus, however, is helping families plan for and take control of their future. Ensuring your assets will go to the people you want, when you want, in the manner you want after you pass away. Preparing for the possibility that you or your spouse will need expensive long-term care-and helping you find ways to pay for it.
Ensuring that people you trust have the authority to make financial and medical decisions on your behalf in the event of incapacity. Protecting your assets and those of your heirs against threats such as creditors, lawsuits, divorce, the high cost of long-term care, and more. We have helped families from all walks of life find solutions to challenges like these and many more.
We welcome the opportunity to do the same for you. Ultimately, our goal is to help you enjoy the peace of mind that comes from having a plan in place for the future. We invite you to contact us for a personal meeting to discuss your particular needs and goals.

Believe or not, you have an estate.
As a matter of fact, nearly everyone does.
There is a common misconception, unless you are very wealthy, you do not need Estate Planning.
Your estate encompasses everything you own-your home, car, checking and savings accounts, investments, life insurance, debts and personal items.
Without an estate plan, our possessions are distributed according to the State law, which may or may not be what you would want.
Estate planning is essentially about three things: Deals with who is in CONTROL of your "stuff", who gets to BENEFIT, and WHEN do they benefit from your "stuff".

Estate planning with retirement benefits is a challenging area dealing with interface of estate planning and retirement benefits.
The paramount concern of many clients revolves around the minimum distribution rules and regulations.
In a major decision, the Supreme Court ruled-Inherited IRA's are not considered protected retirement funds.
This means Inherited IRA's are now considered fully available assets, subject to creditor's claims if the beneficiary files for bankruptcy, divorce.
If you pass a retirement fund down to a child or grandchild, the inherited money will no longer be protected if your beneficiary must file for bankruptcy or divorce.

Asset protection trusts are created to protect assets from long-term care costs, creditors, predators (divorce, accidents, business failures, lawsuits etc).
Asset protection also includes the protection of assets from one's own poor decision making, or fear of not having the mental capacity to manage the assets you have accumulated.
All of these are forms of asset protection planning.
If you want to protect your assets, you do not have to give up control.
Most people confuse asset protection planning with estate planning.
