Attorney Dusty L. Twyman-Morey received her Juris Doctorate from Emory University School of Law in 1998, and was admitted to the Florida Bar that same year. Dusty has an active litigation practice and is also collaboratively trained, with the experience necessary to navigate you through the collaborative divorce process.

Her knowledge and courtroom experience, along with her understanding and implementation of interest-based option building, will guide you through the process of your family law case from start to finish and help you make informed decisions.Dusty and her husband Tom have three children: Natasha, Tommy, and Nick, and three grandchildren: Orion, Aurora, and Violet.

I decided more than 20 years ago that I had a passion and desire to focus purely on this area of law. That you or your spouse has been a resident of the State of Florida for at least six months prior to the filing of your divorce lawsuit.
That your marriage is irretrievably broken (or that one spouse has been adjudicated mentally incompetent for the required period of time pursuant to section 61, Florida Statutes).
Most of you have heard that Florida is a "no fault state."
What this means is that you are no longer required, nor is it appropriate or even permissible, to plead any fault-based ground to qualify for a divorce in Florida.
The collaborative divorce process provides an avenue for you to resolve your divorce in a cooperative, interest-based, solution-oriented manner without litigation so that you are not turning over the most important decisions of your life, your family, your finances, and your future to someone else.
If you and your spouse are willing to work together to resolve your issues without court intervention, the collaborative process provides you with the tools and path to do it.
During this process for divorce, you will work with trained professionals who are adept at guiding you to a fair resolution in a supportive environment.
In Florida, the document that governs the parents' rights and responsibilities for the minor child is called a parenting plan.
A parenting plan is a comprehensive document that deals not only with the day-to-day issues regarding the child but also a standard timesharing schedule, as well as a holiday timesharing schedule.
Parenting plans differ in the level of specificity they provide.
Some parties prefer a very detailed, comprehensive plan in which they attempt to address as many scenarios as they can think of that may arise in the future, even if they don't exist at present.
In determining whether an award of alimony is appropriate, the court will look at the actual need of the party requesting alimony, the ability to pay of the other party, and the standard of living established during the marriage.
All forms of alimony can be ordered to be paid periodically, or lump sum, or a combination of both.
All forms of alimony, unless stated differently in an agreement by the parties, terminate upon death or the remarriage of the recipient of alimony.
If you have a prior alimony award and wish to remain grandfathered into the old alimony tax law, you must preserve that with language in the agreement or supplemental final judgment or you will be subject to the new tax laws regarding alimony.
Child support is a function of a formula which is comprised of both parents' incomes.
Although one parent will typically pay child support to the other, both parents are responsible for financially providing support for their children, and this is contemplated in the child support formula.
Child support is also calculated to include the cost of employment-related daycare and medical insurance for the children.
Child support may be significantly impacted based upon the time-sharing schedule of the parents.
