There are a number of different proceedings which may be filed in the Probate court following the death of a Georgia resident or a non-resident owning property in the State of Georgia.
A trust is a relationship between two parties, in which one party, called the Trustee, has the legal title to property of the other party, called the Beneficiary, who has equitable title of the property.
The trustee manages the property for the benefit of the beneficiary.
A trust can allow one or more people to manage the property for the benefit of the beneficiary.
A trust can be created during a person's life and survive their death, or they can be created by a will and take effect after the person's death.
In order for a will to be valid certain requirements must be met.
Although wills do not need to be in any certain format, all wills must be in writing, signed by the testator (creator of the will), and attested by two or more competent witnesses.
Once a will is created it does not take effect until the testator's death.
Power of Attorney is similar to a living will.
Power of attorney allows you to named someone to make medical decisions on your behalf.
If you become incapacitated, your power of attorney would decide to whether or not life sustaining measures should be used.
