Services
In collaborative practice, we're able to look beyond strictly legal issues to help families resolve conflicts without court intervention.
Your collaborative practice team takes a holistic approach, sometimes enlisting the aid of outside specialists including financial coaches, emotional coaches, and others to bring the best result for everyone involved.
If things become difficult or complex, but you still prefer to stay out of court, mediation may provide the most flexible path forward.
Our neutral, third-pary mediators are experienced at bringing parties together around the table and negotiating a solution, even when emotions run high.
Collaborative Law is a great approach to consider when all parties in a dispute are willing to respectfully communicate their individual needs and interests, and/or when all parties are committed to a process focused on "win-win" solutions based on problem solving and supporting the goals of both parties.
It is especially beneficial and effective when parties are parenting children.
In this approach all parties work with their own attorney and a supportive team of professionals to achieve an outcome based on their financial resources and appropriate care and planning.
Mediation is often considered when the parties prefer to come to a settlement outside of a courtroom with the assistance of a mediator.
The mediator is a neutral third party who facilitates the negotiations between the parties and oversees the process.
Both parties can freely and confidentially present their goals and positions and the mediator can help put these into a mutually-acceptable perspective that will satisfy each party.
At Story Law, when we act as mediators, our core approach of mediation is to work with the parties to arrive at the most acceptable options for both parties in order to reach a settlement.
Arbitration is a process where a third party trier of fact (like a judge) provides you with an answer to the dispute(s) at hand.
The arbitrator must base the ruling on the law.
This is usually a quicker process than going to trial and less expensive.
At Story Law, we will represent clients in arbitration, or we act as the arbitrator who hears presentations about the dispute from both sides, and then we determine an outcome according to the letter of the law.
In order to make arbitration a viable approach, both parties must consent to enter the process and respect the final ruling.
In short, two parties enter this proceeding to establish, defend, or enforce a legal right.
At Story Law, most of our litigation cases reside in the realm of Family Law.
Sometimes, there is a power-imbalance between the parties, especially when parenting is a key issue, or there may be a fear that "money will be left on the table" if a dispute is not settled in the courtroom, with a judge.
This is not necessarily the case.
Each dispute is uniquely different, as are the goals for each party involved.
