My nightmare started in a rental car on my way from LAX up through Ventura where I got pulled over and arrested for DUI.
Not good.
I blew a.20 and this was after I had been driving for an hour.
I was in Cali for work, and am from New York, so I thought I was going to have a nervous breakdown.
The next day after they released me from the absolute hellhole I was kept in (with 5 other inmates), I googled DWI lawyers Ventura and called the first person that popped up.
Mindy called me immediately and started explaining everything to me.
When someone has been arrested of DUI in California, the accused must also deal with the administrative license suspension at a DMV proceeding, which is separate and apart from the Court proceedings.
The officers are not supposed to seize an out-of-state driver's license, although they often do.
Generally California DMV hearings should be requested even if you have an out-of-state driver's license; please contact us to discuss that matter on a case-by-case basis.
A first offense involves a four-month license suspension, while a refusal or a second or subsequent offense within ten years triggers a one-year suspension.
A Ventura county DUI defense to a DUI case generally fall into 3 categories: Driving, officer observations/field sobriety tests and chemical testing.
Remember that 12 jurors must agree on the guilt of the accused in order to convict.
A skilled DUI defense attorney or DMV lawyer is your best hope for creating doubt in these areas and rendering the prosecution's evidence an unreliable basis for the jury to return a guilty verdict, or the DMW to suspend your hearing.
A skilled DUI defense attorney can highlight those areas where the defendant's driving was actually consistent with sobriety.
It sounds simple, but don't drink and drive.
Take a taxi, designate a driver, walk, call a friend, but no matter what, do not drink and drive.
Possibly, it is also unlawful to drive with your normal faculties impaired (by alcohol and/or drugs).
Normal faculties are those faculties of a person, such as the ability to walk, talk, judge distances, drive an automobile, make judgments, act in emergencies, etc.
In California there are enhanced penalties if you refuse to submit to a chemical test after you are arrested.
