Under the New York Penal Law there are various different classifications of assault; first degree, second degree and third degree.
Depending on the type of assault committed and the severity of injury or damage caused, the penalties and sentences handed down for individuals convicted of assault will vary.
If a deadly weapon or dangerous instrument is used during the assault, additional weapons charges may be filed, and the level of assault offense may be higher.
Assault in the third degree is when an individual intentionally or recklessly causes physical injury to another person.
Burglary is committed when a person enters or remains unlawfully in a building with the intent to commit a crime therein.
Under New York law there are three primary classifications of burglary charges.
All of them are felonies.
At a minimum, burglary is a class "D" felony.
Higher felony offense levels occur when the building is a dwelling (a place where people commonly sleep), when the person uses a weapon or dangerous instrument, when a person displays what appears to be a firearm, and when an a person other than a participant is injured.
