Services
Whether you are ending a marriage or facing a child custody or support dispute, skilled legal counsel may be vital to your well-being and that of your family.
I am Barton R. Resnicoff, and I have the experience it takes to successfully handle a variety of matrimonial and family law cases.
When I first started representing family law clients, I practiced with two very different partners, from whom I learned different things.
From one partner, I learned how to practice tough and give no quarter.
From the other, I learned how to use the law to assist my client - how to work with the parties and the other attorney to resolve the case fairly.
There are many tools at our disposal when dealing with custody, parenting time and a parent being denied access to his or her child.
What are the Court's powers and what should be done when there is a total denial of all contact?
A prospective client[1], the father, came in for a consultation recently.
His former wife, contrary to the terms of their divorce, had prevented him from having any contact with his six(6)year old daughter, alleging that he was abusing her; she also alleged that during the time she was with her father, she spent time with a neighborhood girl, the same age, who the mother falsely claimed her mother was the father's girlfriend.
Ending a marriage involves significant financial and personal risks, from the division of assets to protecting the interests of children.
At the Law Office of Barton R. Resnicoff in Nassau County, New York, I provide a range of services to guide my clients through the divorce process.
I am a Board Certified Family Law Trial Specialist* by the National Board of Trial Advocacy.
Having limited my practice to matters of matrimonial and family law for over 40 years, I have honed the skills it takes to resolve divorces as practically as possible - sparing clients from unnecessary financial and emotional costs.
I am often asked about the parties becoming legally separated instead of getting a divorce.
In New York, you can sue for separation as an alternative, or in addition to, a divorce.
Whether or not that makes sense on legal, practical or emotion level is another issue.
To obtain a judgment of separation entails the same work as a divorce, but the parties remain legally married and no distribution of assets can occur.
There are only fault grounds for a separation.
If all that is granted is a judgment of separation, while that decree, after living separate and apart based upon it, can be converted into the divorce decree with a new law suit, the same financial disclosure is necessary and the issues of equitable distribution will have to be dealt with, usually requiring a duplication of effort, attorney time and costs.
Whether you are going through a divorce or are unmarried, it is important that you understand the basics of New York's child custody laws in order to protect your own well-being and that of your child or children.
Having limited my practice to matters of family law for more than 40 years, I take pride in my long-standing commitment to resolving custody disputes in the best interests of children.
Located in Lake Success, I offer legal counsel in child custody cases in Nassau County, Queens County, Suffolk County and the surrounding areas.
