Services
If conflicts concerning your family have reached the point where legal action is necessary, J. Barbour Rixey, P.C. can help.
J. Barbour Rixey, P.C. has served families in Hampton Roads for over 30 years.
We assist families with all aspects of adoptions whether direct adoptions, step parent adoption, or otherwise.
We handle the legalities of your adoption, so you can concentrate on your new family.
Divorce should not lead to a financial crisis.
We will help you receive an equitable amount of spousal support to live to the standard of living you were accustomed to during the marriage.
We know that domestic issues are often emotionally and physically stressful, and when children are in the household, it can become even more stressful.
Unfortunately, the stress level can lead to domestic violence and abuse directed toward a spouse or even to a child.
Often when one of the parents is being abused, so is one of the children.
Children know what is going on in the household.
They see and hear much more than we realize.
If children are living in a home where domestic violence is occurring, action needs to be addressed immediately.
Where there has been domestic violence or abuse in a household or a threat of violence, a party can file a petition for a Preliminary Protective Order against the abuser.
The Preliminary Protective Order is generally issued without much fanfare and often without the appearance of the abuser.
After being issued, the Protective Order is served by a Police Officer upon the abuser at which point he or she is removed from the home.
Another hearing is then scheduled and held within fifteen days to determine if a Permanent Protective Order is necessary.
The court looks at the incomes (all income from all sources) of both parties and then determines the percentage of each party's contribution into the combined monthly gross income.
A base support obligation is determined from consulting the child support guideline chart for the number of children involved.
Employment-related day care and health insurance costs for the children will be factored into the formula before a monthly support obligation is determined.
Finally, depending on the family situation, either the sole custody guideline, the split custody guideline, or the shared custody guideline would be used to calculate the child support.
Whether it is between a married couple or non-married parents, often the issue of paternity of a child will become an issue, particularly if the issue of custody and child support is involved.
If there is any doubt, a spouse or parent will want to know whether or not he is the biological parent of a particular child.
There are support, custody and visitation issues which could be affected, not to mention inheritance issues.
We can guide you through the process of having paternity determined so that each parent or non-parent, as the case may be, can be properly informed.
