Steve Kincaid grew up in Kokomo, Indiana.
He graduated from Indiana University at Bloomington with a B.S. degree (with honors in chemistry) in 1989 and earned his law degree from Indiana University at Indianapolis in 1992.
Steve is actively involved in estate planning and probate administration.
He drafts wills, trusts, power of attorney, and living wills.
Steve also represents clients applying for Medicaid benefits for the aged, blind, and disabled.
What will happen to your family or loved ones upon your death?
A plan for your family after your death is essential.
This includes first and foremost any planning that may be needed for your minor children.
This includes both who should be your child's guardian as well as who will administer any funds left to them.
Secondly, how will your assets be administered upon your death?
We prepare Wills and Trusts, if needed, as well as provide advice and guidance to efficiently leave assets outside of the formal Court probate process.
Once a person dies, probate is not always necessary.
Small estates may be handled through an affidavit process or through a simplified probate process.
Additionally, through trusts and other means, probate avoidance may be possible.
However, some formal estate administration must be done on occasion.
We can review the situation, determine the tasks that need to be accomplished and work to see that the estate is properly administered.
Medicaid provides benefits to the Aged, Blind and Disabled who qualify for Medicaid benefits.
We work to assess whether Medicaid benefits should be sought for nursing home or in-home care.
If Medicaid benefits are sought, we work to develop a plan whereby a Medicaid eligibility plan can be established, implemented and updated.
While power of attorney and legal guardianship can perform similar functions in some cases, they are vastly difference in terms of who is appointed, who does the appointing and how much control the appointed agent or guardian has.
Probate attorneys regularly find themselves assisting clients in applying for guardianship for loved ones who've recently become incapacitated.
In most cases, the loved one would have been better served by choosing the person they wanted to make decisions on their behalf and giving them power of attorney.
