Miller Family Law offers broad experience in all areas of property division.
In Utah, courts will make an equitable division of marital property.
Equitable means fair, not equal.
If you can agree about how to divide your property, the judge must review the agreement to be sure that it is fair, but you do not need to go to court or hold a hearing.
Deciding what is a fair distribution of property includes several factors, such as how long the marriage has lasted, the age and health of the parties, their occupations, the amounts and sources of income and related matters.
Miller Family Law offers broad experience in paternity cases to help achieve the best long term results for you & your family.
Paternity in legal terms means fatherhood.
When a child is born to a couple who are not married to each other, the father of the child does not automatically have the same rights and responsibilities as a father who is married to the mother until paternity is established.
These rights and responsibilities include custody, parent-time, and the obligation to provide financial support (child support).
Miller Family Law offers broad experience in child custody disputes to help achieve the best long term results for you & your family.
There are two parts to custody: physical custody and legal custody.
Physical custody means where the children live.
Legal custody means which parent has the right to make important decisions about the children (such as medical care, education, and religion).
Generally, joint legal custody is presumed to be in the child's best interest unless there is domestic violence, the child has special needs, the parents live far apart, or there is some other factor the court considers relevant.
