Small Claims Court is a division of the California Superior Courts, designed to be venues where consumers and small businesses can litigate civil damage cases without lawyers in the courtroom.
Individuals and sole proprietors can bring claims for as much as $10,000.
Corporations, partnerships, and LLC's can bring claims for as much as $5000.
The rules of procedure are much different in Small Claims Court than they are in the regular Superior Court.
The Judicial Council of California has also adopted a different set of forms for use in Small Claims Court proceedings.
The Law Office of Allen J. Capeloto was established in 1986, in downtown San Francisco.
Prior to that, Allen Capeloto was an associate attorney with the firm of Pechner, Dorfman, Wolffe, Rounick & Cabot, of Philadelphia, the Law Office of Glenn Lerner, of San Francisco, and then a partner in the firm of Capeloto & Rubin, of San Francisco.
In 1994, our office was relocated to San Mateo County.
Our principal areas of practice are in business and corporate law, real estate and condominium law, construction law and mechanic's liens, and general civil litigation.
We provide a full spectrum of legal services to our business clients, most of which are small and closely held businesses.
We represent Sole Proprietors, Partnerships, Corporations, LLC's, and unincorporated Associations.
We understand that a business has a life of its own, and we are there for our clients from formation to dissolution, and everything in between.
We write and review business contracts and agreements.
We give proactive counsel and advice on a variety of business matters to keep our clients in compliance with laws and statutes, and out of the courthouse defending civil claims.
Over the years, we have represented homeowners, real estate agents and brokers, developers, builders, landlords, tenants, design professionals and engineers in relation to the use and sale of real estate.
Our work in this field goes well beyond the borders of San Mateo County, as we have provided services to clients with land located in virtually every Bay Area county, as well as in Southern California.
We draft real-estate-related contracts, both residential and commercial; including sales agreements, agreements between tenants in common, easements, deeds and leases.
We have represented designers, builders, engineers, contractors and homeowners in construction-related matters, whether for residential or commercial properties.
While some of this work is transactional, involving the preparation of construction contracts and related documents, the recording of Mechanic's Liens, or assisting in permit applications, many of our cases in this area have also involved disputes and litigation.
Our 30+ years of trial experience includes defending construction defect claims on behalf of licensed contractors and design professionals, prosecuting and defending basic breach of contract actions, and representing homeowners as well as contractors in cases resulting from Mechanic's Liens.
