Property that was acquired prior to the marriage is considered the separate property of the party acquiring the property and not subject to division with the other party.
However, it is possible to have a community lien against the separate property.
Property acquired during the marriage is presumed to be community property subject to division.
The situation of property acquired prior to the marriage is subject to a community lien that arises most frequently in the case of real estate.
If the property is purchased prior to the marriage, but the mortgage principal is paid down during the marriage or other community money is put into the property during the marriage, the community is entitled to a share of the equity for those contributions.
