Divorce (also called "dissolution of marriage") is a difficult process.
There are various complex factors to consider, including: child custody, visitation, child support, spousal support and the division of marital assets and debts.
California is a "no-fault" divorce state, which means neither spouse needs to prove the other spouse is the reason for the divorce.
Rather, you or your spouse may simply state there are "irreconcilable differences" or there has been an "irreparable breakdown of the marriage" when filing for divorce.
Property is generally referred to as anything that can be purchased or sold (house, car, furniture, etc.) or anything that has value (bank accounts, retirement plans, stocks, life insurance with cash value, a business, etc.).
In California, a property is characterized as a community or separate property.
Each spouse owns one-half of the community property and is responsible for one-half of the community debt-even if only one spouse incurred the debt during the marriage.
Usually, community property and debts are divided equally between the spouses.
Child support is the amount of money a court orders a parent to pay each month to help pay for a child's living expenses (such as food, clothing, medical care and educational costs).
California law requires both parents to be equally responsible for providing for their child's financial needs-regardless of whether the parents are married or unmarried.
However, the court cannot enforce this obligation until it makes a child support order.
If one of the parents is receiving public assistance, or if a case has been opened with the Department of Child Support Services (DCSS), the state agency will automatically start a child support case against the other parent.
We are sensitive to the fact that legal fees can add up quickly and are not entirely within your control given that you can regulate your own choices and conduct-but not decisions made by your spouse, former spouse or the other parent.
