In Pennsylvania, there are two forms of divorce: fault and no-fault.
Fault divorces are very uncommon and can be expensive to prosecute.
Pursuing a fault-based divorce often does not enhance the moving party's economic claims.
The no-fault divorce is far more common in Pennsylvania.
A no-fault divorce can either be entered by consent or by the court in the event that there is not consent from both parties.
Both parties can consent to the entry of a divorce decree at any time after 90 days from the date the divorce complaint is served.
Equitable distribution is the process of dividing the assets and debts accumulated during marriage following separation.
Equitable distribution does not necessarily dictate an equal division of assets and debts.
The attorneys of BGMS have handled cases with millions of dollars in marital assets and are experienced in negotiating or litigating the best manner in which to distribute assets in marital estates with few assets and those with a very high value.
If an agreement is not reached by the parties, the court will hear testimony and apply the factors listed in the Pennsylvania Divorce Code to determine the assets and debts each party should receive at equitable distribution.
The lawyers at Bunde, Gillotti, Mulroy & Shultz P.C. (BGMS) have many years experience negotiating alimony and spousal support.
This includes cases with complex, high net worth issues and cases without such issues.
Each case is unique and the lawyers at BGMS are experienced in all cases.
The process for working through asset division and ongoing spousal support for high-value clients is the same as any other divorce, just more in-depth.
Whether you are the spouse who is aiming to receive or pay alimony or support, we will carefully research and analyze your financial situation to ensure the best possible outcome.
