Normal procedure is to copy every document that comes in, and every document that goes out, so that the client should have (and should keep) a complete copy of our file, and know just what is going on as the case progresses.
Divorce is an awful thing to face.
It tears families apart and causes pain to all involved.
Sometimes, however, it's simply the best solution to the problem of two people who can't iron out their differences.
When this happens, you'll need the best divorce lawyer to handle your case.
The right attorney can not only help to speed up the process, but can sometimes even help to reduce the pain and anger, and aid in both sides coming to an acceptable agreement.
Nevada is a no-fault state.
This means that in this state, the spouse who files for divorce doesn't need to prove that the other spouse was in any way at fault.
A truly uncontested divorce can be issued within a week or two of the time the papers are completed and filed (judges vary a bit on how fast they process the paper; but it could be as little as a couple of days).
Filing fees keep changing and are unavoidable.
Currently, they now cost close to a $1,000 (total for both sides).
The rest of the retainer requested would be for attorney's fees, but if the case is truly uncontested, the time (and therefore the money) consumed to put together all required papers is fairly modest, and we reduce our retainer accordingly.
Since 1983, Nevada has had some provision for "summary divorce procedures."
By 1987, it had matured to the current Joint Petition (Summary Proceeding) law, for the stated purpose of simplifying the procedures for divorce when both parties were in agreement, and eliminating costly court proceedings for proper person litigants.
Forms for such divorces are even posted on the self-help center's website.
Critics have charged that the process, when assisted by an attorney, inherently gives the appearance that the attorney is representing both parties, which would (of course) be an actual conflict of interest.
Some kinds of orders can be obtained immediately upon filing for divorce.
For example, either party, upon request, may obtain a "Joint Preliminary Injunction, " or "JPI, " which provides that both parties are restrained from: (1) disposing of co-owned property (with some exceptions); (2) molesting, harassing, or injuring the other spouse or a child; and (3) attempting to relocate with a child and so deprive the court of jurisdiction as to the child.
More specific requests for assistance from the Court must be requested by motion, which may be filed at any time from the filing of the divorce Complaint until the end of the case.
