In a Chapter 7 Bankruptcy, we show the Georgia Bankruptcy Court that, based upon your budget, you are unable to service the debt you carry.
That's it.
Approximately 90 days after we file you are granted a discharge, and you no longer owe the debt.
Now, while a Chapter 7 Bankruptcy is simple in theory, there are a number of factors to consider.
First you must qualify financially through a mandated "Means Test."
Not every kind of debt can be discharged in a Chapter 7 Bankruptcy, either.
We will help you develop a repayment plan for your debts.
It will be stretched over a 3 to 5 year period, giving you time to pay off your debts.
This is not an immediate discharge of debt like with Chapter 7, but a way to pay your creditors and possibly save your home from foreclosure.
Chapter 13 does require "priority claims" such as recent tax bills and child support to be paid in full.
