Most people never imagine that they will be arrested and charged with a crime and assume that anyone who is arrested must be a criminal. The truth is that anyone can be arrested. Unlike many other defense attorneys I am NOT a former Assistant District Attorney nor a former police officer. I don't judge our clients, I just defend them. In fact, I came to the practice of law as a second career.

Prior to becoming an attorney I spent 20 years as a business executive, eventually running a large subsidiary of a Fortune 500 company. While those years in private business were challenging and rewarding, there came time that I wanted to do something different and more directly related to assisting other people. So, I left the business world, went to law school, passed the New York State bar exam and became a practicing attorney.

So, I left the business world, went to law school, passed the New York State bar exam and became a practicing attorney.
Some times getting a traffic ticket isn't a big deal.
You sign the back, pay a fine and it's over with.
However, all too often the guilty plea and fine are only the beginning of a costly experience.
If the ticket was for a "moving violation" such as speeding, failure to obey a traffic signal or sign, failing to maintain lane, etc., the guilty plea is reported to the NYS Department of Motor Vehicles where it becomes part of a driver's record.
Each violation has a statutorily prescribed "point" value that stays on a driver's record for 18 months.

A mistaken identification, a misunderstanding or dispute with the police or another party, even simply being in the wrong place at the wrong time can lead to being taken into custody by the police and charged with an offense.
Being arrested can be one of the scariest moments in anyone's life.
Suddenly your liberty is taken away and you may face the prospect of months or years of incarceration.
For most drivers getting a traffic ticket isn't a big deal.
They sign the back, pay a fine and it's over with.
But, if you have a CDL and drive for a living, particularly if you drive for a trucking company, the consequences of a simple speeding ticket can be dramatic.
A single speeding ticket can take a driver off the road!
In addition, commercial drivers don't just face the usual traffic violations that most drivers do.
They also face a whole multitude of violations contained in New York State's Transportation Law (TL).
Many inmates in the NYS Corrections system are eligible for parole before their full sentence has been served.
Technically, inmates who are paroled are still in the "custody" of the NYS Department of Corrections.
However, they are serving the remainder of their sentence outside of prison and under the supervision of the state.
Parole is granted or denied following a "parole hearing".
Initial parole hearings are typically held after an inmate has served the "minimum" part of an indeterminate sentence and at least every two years, thereafter.
