Chapter 7 is often referred to as "straight bankruptcy" "simple bankruptcy" or "fresh start bankruptcy."
It is a straight forward case that typically lasts around 4 months from the filing date to the close of the case.
We help and prepare all the necessary paperwork to file a Chapter 7.
After filing, a "Trustee" is appointed to investigate your assets and debts and there is a short meeting with the Trustee during the case.
Chapter 13 Bankruptcy is also called "wage earner bankruptcy" and "repayment plan bankruptcy."
Chapter 13 usually involves submission of a 3 to 5 year repayment plan where you pay certain debts and discharge (eliminate) other debts.
We can help prepare all the necessary Chapter 13 bankruptcy forms.
Payments can be deducted from a paycheck or mailed to the Chapter 13 Trustee.
At the end of the repayment plan, you receive a discharge that eliminates remaining debt, with some exceptions for special types of debts.
Chapter 12 bankruptcy in Georgia.
Chapter 12 cases, also referred to as "farm reorganization" or "family farmer bankruptcy, " is a process that allows farms to restructure their assets and debts through a plan of reorganization.
Qualifying for Chapter 12 varies depending how whether the farmer is an individual or a corporation.
Generally speaking, if your assets and debts are primarily related to farming activity, then you probably qualify to file a Chapter 12.
A Chapter 12 bankruptcy case is much more complicated than a Chapter 7 or Chapter 13 because there is more property, more debt, and an ongoing business.
