Estate planning is simply the process of putting your affairs in order should you become incapacitated or pass away.
Having a solid estate plan is the best gift that you can leave for your loved ones.
It will ensure that your assets pass to your beneficiaries in a quick and cost-effective manner.
Authorizing someone to make medical decisions on your behalf if you are unable to make them yourself.
Maximizing the transfer of assets to your beneficiaries in a manner and method determined by you.
Reducing the cost and delay associated with the transfer of your assets upon your passing.
When a loved one passes away, his or her estate often has to go through a court-managed process called probate or estate administration before the assets are transferred to the beneficiaries.
The length of time needed to complete the probate process depends on the size and complexity of the estate, as well as the requirements and schedule of the local jurisdiction.
Probate can seem like a daunting task, especially after just losing a loved one.
If you are named as an Executor of an Estate, you are responsible for carrying out the provisions of the Will, which includes collecting assets, paying debts and taxes owed, filing tax returns and distributing assets to the beneficiaries.
Sometimes when a person becomes legally incapacitated and cannot independently make decisions about finances, medical care or other important life activities, it is necessary that the court appoint a guardian or conservator for that person.
A person may have been injured in an accident, continue to suffer from an incapacitating physical illness or psychological disorder or have some other condition that prevents him or her from caring for himself or herself.
While guardianships and conservatorships seek to maintain a person's independence, they should only be considered in appropriate cases because they may significantly impinge upon the rights of the individual.
We regularly advise small businesses regarding employment issues, ranging from overtime pay or dealing with an employee's medical condition to drafting employee handbooks, employment agreements, non-competes and providing management training on HR issues as well as dealing with termination and severance matters.
Regardless of the size of the company, it will be faced with employment issues and we offer the education and guidance you need to stay on track and help you strategically deal with workplace issues.
