We counsel our clients to explore reasonable settlement options, but when settlement cannot be reached, we develop a creative and effective litigation and trial strategy to enhance our client's ability to achieve favorable results.
Settlement is of course preferred, but when a fair settlement cannot be reached - most lawyers hesitate to try matrimonial cases.

Just as in all other types of divorce cases, high net worth cases involve such issues as maintenance (alimony), child custody, and child support.
Where high net worth cases tend to differ is in division of marital property.
Because the assets and property in these types of cases are substantial, of varied types and can have substantial tax consideration, dividing up the property in a way that is beneficial to both parties can be more challenging.
In addition, determining how property should be divided and allocated based on New York equitable distribution laws can be complex.

The new Domestic Relations Law §236 (B) ( 5-a) provide drastic changes - that must be understood to achieve the best results.
The prior law only provided guidelines and formulas for pre-divorce, or temporary maintenance awards.
Now the law will apply the same 2 formulas to temporary maintenance and post-divorce maintenance awards.
The prior law applied equally to parents with children paying child support, even if the maintenance payor was also the custodial parent.
The new law will use a different formula requiring less maintenance for a maintenance payor who is also the non custodial parent and paying child support.
