Services
In Maryland, all workers compensation cases are governed by the Maryland (state) Workers Compensation Commission (WCC).
A case is commenced officially by filing a claim form.
Countless cases come to me where an insurer has opened up a case but no claim has been filed with the Workers' Compensation Commission.
Since the WCC is totally independent of the insurer, it happens quite frequently.
If there is no claim filed with the period of limitations, the claim is barred by law.
Generally, the limit is 2 years for accidental injury claims or up to 3 years for an occupational disease claim.
In either West Virginia or Maryland, personal injury (PI) cases can come in different forms.
Premises liability where an individual falls or is otherwise injured by a defect in the property of the defendant.
We practice primarily in two states and the law in Maryland and West Virginia are probably as far apart (different) as any neighboring states in the country.
This can have a drastic impact on how your case may be treated in each of the two states.
We will be happy to explain the law as it relates to your particular case when you schedule an appointment.
Social Security Disability and Supplemental Security Income cases are the two prongs of what people commonly call "social security" cases.
In both instances, it is necessary to prove under the federal law and regulations that an individual is disabled and is qualified for benefits.
In general, SSD benefits are based on a workers wages and the amount is determined by their level of income within the government regulations.
SSI is needs-based and requires (in addition to being disabled) a paucity or lack of assets or money.
