When you or a loved one faces a health crisis, it can be overwhelming to consider how to protect your assets and give your family peace of mind.
Whether one need long term care, nursing home or in-home assistance, or suffers illness or incapacitation, there is much to consider, and the costs for these services can consume savings and assets, or place a burden on loved ones.
It is ideal to put a plan in place well before any health crisis.
The proper documentation and planning should be done, both to protect assets, and to make sure the appropriate people in your life are authorized and able to act on your behalf.

If someone close to you is unable to manage their own personal or financial affairs, they may need to have a Court appoint a guardian in their behalf.
Our firm can guide and assist you in all aspects of this process.
We will help you determine the most qualified person for the guardian role, and will walk you through all parts of the guardianship proceeding-from filing the necessary forms and documentation with the court, to aggressively advocating for your loved one's best interests throughout.

A last will & testament is a legal document that provides instructions for the distribution of your assets after your death.
A will can also name a guardian if you have minor children, and can include, what are called "ethical will" provisions related to values, and deeply felt wishes to pass on to future generations.
A probate court is a special court in the judicial system that is tasked with handling issues concerning wills, trusts, estates, conservatorships, and guardianships.
If someone disputes or contests a will-perhaps because they've been excluded or they feel the decedent was under duress or didn't have the capacity to sign the will-the probate court will hear the claim and rule on the issue.

A power of attorney is a legal document that permits the creator of the document (known as the "principal") to name one or more agents (or "attorney(s)-in-fact") to act for him or her.
Specifically, the principal delegates the management of his or her legal and financial affairs to the agent(s).
A durable power of attorney takes effect immediately upon the agent's acceptance of their authority.
A springing power of attorney, on the other hand, goes into effect at a future time.
It typically takes effect only when the principal becomes incapacitated, typically requiring medical certification.
