Chapter 7 eliminates most debt completely without risk of losing your home, vehicle, retirement accounts, personal property, checking accounts, etc. Common types of debts that are totally eliminated in a Chapter 7 include: credit cards, medical bills, deficiency balances on repossessed vehicles, personal loans, foreclosures, and payday loans. And, despite what some people may think, you CAN protect your home, vehicle, retirement accounts, and personal property in a Chapter 7 bankruptcy case.

Of course, this does not apply to everyone but it is true in the vast majority of cases. It is our job as your attorney to tell you up front whether or not any of your property is at risk. Pay your attorney fees and your creditors with one easy monthly payment! Process your monthly Trustee payment directly through your company payroll!

Reasons for filing a Chapter 13 include: (a) when you need a case filed fast, for example, when a wage garnishment is pending, and don't have the money to pay your Chapter 7 fees in full before you file; (b) when you are under the eight year Chapter 7 filing time bar; (c) when you have mortgage arrears that you wish to repay and keep your home; (d) when you are disqualified by the "means test" from the filing of a Chapter 7; (e) when you have too much equity in your real and personal property and are therefore disqualified from filing Chapter 7; and, (f) when you want to pay back past due Federal or State income taxes in a timely and efficient manner.

Our experience is that THERE ARE MANY PEOPLE IN THE CHICAGOLAND AREA PAYING TOO MUCH FOR THEIR CHAPTER 7 BANKRUPTCY.
Chapter 7 attorney fees vary from attorney to attorney and have increased dramatically over the past decade due to the complexities in the new law.
Many attorneys will refuse to quote you a price up front for their services.
CHAPTER 13 fees are set by the Court at $3,500 and can be paid in installments through the Chapter 13 Plan.
In some cases a down payment on attorney fees is required before the filing of your Chapter 13 but in most instances the main benefit of filing a Chapter 13 versus a Chapter 7 is that little or no attorney fees have to be paid before the case is filed.
