The first offense is Driving While Ability Impaired (DWAI).
This offense is committed where the driver consumed alcohol to the extent that he "has actually impaired, to any extent, the physical and mental abilities which he is expected to possess in order to operate a vehicle as a reasonable and prudent driver."
People v. Cruz, 48 N.Y.2d 419, 423 N.Y.S.2d 625 (1979).
DWAI is a traffic infraction and not a crime.
DWAI is an offense to which the more serious charge of Driving While Intoxicated (DWI) is often reduced.
In some cases, when you are arrested for certain misdemeanor offenses, you may receive a Desk Appearance Ticket (DAT), a document advising you when to make a court appearance at a future date.
You may also be eligible for a Desk Appearance Ticket if the highest offense is a class "E" felony, although the DAT process in any felony case is not the norm.
The purpose of the Desk Appearance Ticket is to require the person to appear in court to answer the charges.
If you are arrested and issued a Desk Appearance Ticket, you will not be put "through the system" in the criminal courts in Nassau County, Suffolk County, Queens County, Kings County, New York County and the Bronx County and will be released from custody at the police station.
