Your median income is determined by averaging your income for the last six months.
Can I still file for Chapter 7 Bankruptcy if my income is higher than the median income guidelines?.
If your income is higher than the median income limits for your household size you may still qualify to file for a Chapter 7 Bankruptcy by completing a means test which will calculate both your income and qualified expenses.
A Chapter 13 Bankruptcy is a reorganization bankruptcy which is designed to reorganize your debts and to create a plan to payoff a portion of those debts at a reasonable and manageable rate.
Your income, expenses and types of debt will determine the amount that you pay back as well as your monthly payment amount.
You can expect to continue to make Chapter 13 plan payments for 3-5 years depending on the plan.
