In North Carolina you start a guardianship proceeding by filing a verified petition with the Clerk of Superior Court.
The incapacitated person or "respondent" must be personally served.
An attorney must then be appointed to represent the respondent.
This attorney may be discharged if the respondent hires their own attorney.
If the Clerk believes that there is an imminent or foreseeable risk of harm to the respondent the Clerk may appoint an interim guardian.
The next step is a hearing.
If the court finds by clear, cogent, and convincing evidence, that the respondent lacks sufficient capacity to manage her own affairs or is not able to make or to communicate important decisions concerning her person, family, or property it can adjudicate the person to incompetent.
