Available to both businesses and individuals, a Chapter 7 bankruptcy is a liquidation of your non-exempt assets.
Many people who are not familiar with bankruptcy do not know that Chapter 13 exists.
A Chapter 13 is different than a Chapter 7, where you are essentially released of all your debts but will not get to keep any of your assets.
In a Chapter 13, you keep your home and vehicle and will have 5 years (with interest stopped) to pay back what is owed on your mortgage and car loan.
Most of your credit card and consumer debt will be erased entirely, with up to 90% of it forgiven.
Another benefit of the Chapter 13 is that it stays on your credit report for a maximum of 7 years - and there are ways to start improving your credit right away so that you can have a very good credit score well before 7 years is up.
Chapter 7 is often what many people think of when they think of bankruptcy.
Chapter 7 gives you a clean slate.
It does not protect your home from foreclosure, so if that is a concern for you, then you will want to file a Chapter 13.
Chapter 7 bankruptcies are also less expensive to file.
It will last longer on your credit report than a Chapter 13, but nothing is worse for your credit than continuing to miss payments for years!
Filing a Chapter 7 also puts an immediate stop to creditor harassment.
