Why Do I Need an Estate Plan?
You already have an Estate Plan, even if you don't realize it.
The government has created an Estate Plan for you, called intestate succession.
Intestate succession means that your property will be distributed according to the government's plan for you, instead of the way you would want your property to be distributed.

What is Probate?
When a person passes away, he or she may have owned many different kinds of property.
This could include bank accounts, a home, a business, stocks and bonds, and personal effects.
Probate is the court supervised process in which a deceased person's property is ultimately distributed to his or her beneficiaries or heirs at law.
This process requires multiple court filings, notices to be published, hearings, and that a person be appointed by the court to serve as the Personal Representative.

What Kinds of Cases Does Estate Litigation Include?
Many Estate Litigation cases involve either a will or a trust that was improperly created.
An elderly or incompetent person was coerced to sign the document, or because he or she did not understand what the document was.
Many times these cases involve dementia, Alzheimer's, or other medical conditions that can require medical experts to testify.
Other Estate Litigation cases involve a trustee of a trust or an executor of a will who does not meet their fiduciary dates in administering the estate assets, or more, has used them for their own purposes.
Mark A. Homen has been practicing law continuously in Hayward, California since 1983.
He was born and raised in the East Bay.
He graduated from Moreau High School, and received his Bachelor's degree in Political Science and Mass Communications from California State University, Hayward with high honors.
After graduating from CSUH in 1979, he attended and graduated in the top third of his class from Santa Clara University Law School in 1982.
Mark has three children, Luke, Amy and Kyle and two stepchildren, Zachary and Sara.
