The law can be intimidating, but the lawyer you work with can make a difference.
California is a no-fault divorce state, meaning that evidence of fault is improper and inadmissible, unless allowed by statute.
Generally, the courts will allow for dissolution upon a showing, by one party domiciled within the state, that there is an "irremediable breakdown" in the marriage.
This is typically shown where there is serious disagreement or action that is adversely affecting the marriage that no amount of counseling or therapy could resolve.
Other forms of dissolving a marriage include legal separation and annulment.
A marriage may be dissolved by dissolution, legal separation, or by nullity (invalid marriage).
In Dissolution and Legal Separation Proceedings, the court rules on the rights and financial responsibilities of the parties.
A Dissolution of Marriage dissolves the marriage and restores the spouses to single status.
A Legal Separation, on the other hand, rules on the same rights, but without completely dissolving the marriage.
There are several reasons that someone might prefer a legal separation to a dissolution.
A Dissolution of Marriage dissolves the marriage and restores the spouses to single status.
A nullity proceeding, on the other hand determines whether or not the parties were validly married in the first place.
If determined that the marriage was invalid from its inception then the parties were deemed never to have been married in the first place.
This can create several problems depending on the circumstances such as length of marriage and the commingling of funds.
An annulment can be based on several circumstances, but usually occurs when a party is already married or their previous divorce had not been properly finalized.
Typically, Move-Away Cases refers to change in the child or children's residence and is a request by the custodial parent to move away from the current location established in a prior order.
A parent who has established physical custody of a child has the right to change the residence of a child, subject to the courts ability to restrain removal of the child if such a move would interfere with or prejudice the rights or welfare of the child.
Family Code §7501(a); Marriage of Burgess (1996) 13 C4th 25, 32, 51 CR2d 444 (court may not interfere with the move unless it is detrimental to the child).
