You will save time and money, and usually accomplish better results, by settling your case amicably with the other party.
However, this is contingent on both parties' willingness to cooperate in the process and access to the paperwork needed for you and your attorney to make informed decisions regarding your case.
If financial records, asset valuation information, etc. is available to you, you and your attorney can work together to craft a settlement proposal for the opposing party's consideration, and your attorney can provide legal authority and explanation to help educate the other party and guide the process, in an effort to improve your chances of settlement.
Whether a petition to divorce or separate is filed, you must ask the court to resolve all issues between you.
The biggest difference between a divorce and separation judgment is one line item which addresses your marital status.
In a separation, your status changes from married to legally separated.
In a divorce your status changes from married to divorced.
One continues your marriage in limited form, one ends the marriage.
Custody, parenting time, child support, spousal support, asset and debt division, name change preferences and all other issues applicable to your case will be resolved in either a divorce or separation.
Sometimes clients and attorneys have very different ideas, at least initially, about the best approach to take in a particular case.
For example, should a cooperative and friendly approach be taken or should an aggressive and more rigid approach be taken.
Should you compromise as much as possible or are you creating a bigger "monster" by doing so.
Each approach is called for in some circumstances, but whether to take one approach or the other can be difficult for the person involved in the case to objectively asses.
Hiring an attorney and formally litigating family law issues can be expensive and stressful.
It may also have a chilling effect on your relationship with your spouse.

Just as in the case of asset division, debt division decisions made by the court are made with an overarching goal of reaching a just and equitable result under all of the circumstances.
Just as in the case of asset division, a prenuptial or antenuptial agreement may override the otherwise applicable law.
Generally speaking, however, debt incurred during the marriage for a jointly beneficial purpose is divided equally.
Debt tied to an asset awarded to one party or the other will generally be awarded to the party who is awarded the related asset.
