A U.S. citizen who pleads guilty to an offense, often to a lesser charge to prevent jail time, usually pays a small fine or obtains probation and returns home relieved not to serve jail time.

For aliens, immigrants and even lawful permanent residents a guilty plea, resulting in a small fine or probation, can result in deportation or removal from the U.S. Entering the U.S. without a visa (EWI) and remaining here more than 1 year illegally allows that person to apply for permanent residence though an LPR or U.S. C. spouse. A waiver or pardon is necessary which requires them to return to their home country for a minimum of a few months to submit the application.

To be approved that person must prove extreme hardship to their U.S. citizen or lawful permanent spouse or parent.
