Diabetes is tough enough without being confronted with discrimination at work or school; having your driving license suspended due to a low blood sugar incident; being refused proper and necessary care by a health insurance carrier, HMO, nursing home, or other caregiver. I have Type One diabetes, and have faced some of these problems in my own life and worked with thousands of ohers over the past twenty years in handling legal problems related to diabetes.
As a volunteer for the Diabetes Control and Complications Trial ("DCCT") sponsored by the United States National Institutes of Health, I learned early on how to manage and live well with diabetes. It wasn't easy. Along the way I faced many of the problems that those of us with a serious chronic illness often face but, as an attorney, I had the knowledge and background to find a way to respond without my rights, interests and health being compromised.

As a trial lawyer in California who has type 1 diabetes, I have represented more than two dozen people with diabetes whose driver's licenses were suspended by the state Department of Motor Vehicles (DMV).
While all of my clients eventually had their licenses returned, they all suffered emotionally and financially while inadequately trained and overworked DMV hearing officers delayed and denied the return of their driving rights for weeks or months at a time.
California law, like that of all states, provides that a driver's license may be suspended if a person with diabetes is found to be an unsafe driver.

Advising the Department of Motor Vehicles in California that you have diabetes will not necessarily result in a loss of your driving license.

If the DMV becomes concerned that you are an unsafe driver after reviewing the answers provided, your license may be suspended; or, you may be ordered to attend a hearing to answer additional questions about your diabetes.
Problems are likely to arise at this stage.
Doctors are not normally paid to fill out these forms.
Doctors do not always spend a lot of time answering these forms and may not fully understand how to fill them out.
