Divorce is emotionally and financially devastating.
With 40 - 50 % of all marriages ending in divorce, it is important that everyone has some knowledge about how a divorce works and how to protect oneself during a divorce.
I find that most people are scared by those things with which they are unfamiliar.
Knowledge is empowerment.
The following are several misconceptions of which one should be aware.
MYTH - If I leave my house, I am giving up my right to any share of the equity in the home.
In essence, I am abandoning my house.
Cancel all joint credit cards - Although most credit card companies do not allow you to cancel the card without paying the debt in full, you should notify them that you do not wish any more charges to be placed on the card by either you or your spouse.
Do this in writing and keep a copy for your files.
Get a credit report - Know what debt is outstanding at the time of the divorce.
You don't want to obtain a divorce and fail to assign responsibility for a credit card or other debt, which may cause you to be responsible for the debt without obtaining relief from your ex-spouse.
Mediation is a voluntary process through which parties come together to negotiate a mutually acceptable agreement with the assistance of an impartial mediator.
Divorce/family mediation offers a cooperative forum in which two parties discuss and resolve issues regarding children, property and financial issues.
The mediator provides the parties with a framework for making informed, practical and fair decisions.
By working out your own solution rather than accepting a settlement imposed by the courts, you can maintain control over the decisions affecting your life, thereby reducing the emotional and financial costs of an antagonistic divorce.
