The law on the crime of statutory rape, also known as unlawful sexual intercourse, is found at California Penal Code Section 261.5(c) & 261.5(d).
The crime of statutory rape or unlawful sexual intercourse may be chargued as a felony or as a misdemeanor in California.
For purposes of this article we will refer to the crimes of statutory rape and unlawful sexual intercourse simply as statutory rape, which the most common name for this criminal charge.
In short, it is a crime in California for a person who is over the age of seventeen to have sexual intercourse with a person who is under the age of eighteen.
The definition of prostitution is defined at California Penal Code section 647(b) as "soliciting, agreeing to engage in, or actually engaging in, any lewd act between persons for money or other consideration."
Loitering for the purpose of prostitution charged under PC 653.22(a) is charged where the district believes he or she can prove beyond a reasonable doubt that the defendant had the intent to solicit a prostitute because of his or her behavior such as driving around street prostitutes and loitering in the area of prostitution activities.
The law on the crime of "Pandering" is found at California Penal Code Section 266i(a) PC.
Pandering is a felony in California.
If the defendant is found guilty of the crime of pandering the defendant faces up to six years in prison.
If the defendant is found guilty of the crime of pandering another person under the age of sixteen the defendant faces up to eight years in prison.
The crime of pandering (PC 266i(a)) is committed if the defendant influences, encourages, entices, persuades, defrauds, threatens, arranges, procures, or otherwise requests, that another person engage in prostitution, or remain as aprostitute, in house or place of prostitution, AND, that the defendant (panderer) intended that the other person be a prostitute.
In California, the term "Sexual Assault" is a generic term for more specific criminal charges.
There are many types of sexual assault crimes in California.
Generally speaking, sexual assault charges are assault or battery charges with a sexual element.
This means that the defendant is accused of touching, harming, or placing another person in fear of a touching or harm, while the defendant was motivated by sexual arousal to himself or to the victim.
Sexual assault charges carry very stiff jail or prison sentences.
The crime of oral copulation in California comes in several varieties depending on the status of the victim.
For example, there is a different oral copulation charge where the victim is under a certain age (minor), is disabled, is known to the defendant, is intoxicated, is confined in jail or prison, is seduced by fraud, is acted upon with force or in concert, and so on.
