You are here: Home / Cordell & Cordell Family Law Practice Areas / What is Spousal Support, Alimony, and Spousal Maintenance?
In some instances, a wife will ask for alimony, also known as spousal support or spousal maintenance.
Alimony is the court-ordered payment of money to your wife after the dissolution of marriage.
If you made more money (especially if you were the primary breadwinner), there is a good chance your wife will seek alimony.
The bigger the difference in earnings and the longer you were married, the larger the alimony payment will be.
Child custody refers to the rights and obligations between parents, regarding their children, after a divorce, legal separation, or paternity decree.
There are two independent types of custody.
Physical custody refers to the amount of time each parent is permitted physically with a child.
This may be sole, primary, or joint custody.
Legal custody refers to a parent's decision-making rights regarding a child's health, education, and welfare.
It, too, may be sole, primary, or joint custody.
Often, the Court designates one parent as the primary physical custodian, giving the other parent a schedule of temporary custody and visitation.
Child support is a legal obligation in the form of regular payments made by a parent to benefit their child.
This money is used for basic expenses and necessities such as food, housing, clothing, health care, and educational needs.
Regardless of your fight to gain custody of your children, child support will be an issue in your case.
You will either be paying it or receiving it.
Courts have little discretion in setting the amount of child support to be paid.
This is because, as a condition of receiving federal aid, the states are required to follow certain standards in their child support statutes.
Contempt of court typically refers to a willful action that disturbs, disrespects, or disobeys the orders or dignity of the court, judge, or other participants.
Contempt of court can only come into play after a court has issued judgments, orders or decrees to govern the behavior of the parents, which it can do at any point during the divorce proceedings.
Once a court has issued such decrees, it is important for you to observe them to the best of your ability and, at the same time, to take note of any potential violations on the part of your ex-wife or former partner.
Cordell & Cordell divorce attorneys work to ensure every client has the divorce information and family law resources they need to understand the divorce process and know what to expect before meeting with a family law attorney.
A divorce can be a long process, and preparation is key in minimizing the length of your case.
Before divorce proceedings begin, the husband or wife must petition a court for a judgment of divorce.
Attorneys usually draw up these documents for the Petitioner (otherwise known as the Plaintiff or person filing for divorce).
