Mr. McElhinney practices criminal defense, personal injury, civil rights, family law and general civil litigation. Mr. McElhinney earned his Juris Doctorate from the University of New Mexico School of Law in 2003 and graduated from New Mexico State University in 2000 with a Bachelor of Arts in Government.

Prior to completing his education, Mr. McElhinney served as an infantryman in the United States Marine Corps and is a graduate of the Marine Corps Recruit Depot at Parris Island, South Carolina, and the Marine Corps School of Infantry at Camp Geiger, North Carolina.The training and ideals he learned in the Marines still serve him well today as a practicing attorney.

I am C. J. McElhinney and since 2003 I have been an attorney in Las Cruces, New Mexico.
I was born in New York City, moved to the Pocono Mountains of Pennsylvania as a child, and joined the United States Marine Corps in 1992.
I attended recruit training at Parris Island, South Carolina, and then served as a Marine infantryman.
I moved to Las Cruces in 1996 and attended New Mexico State University using my G.I. Bill benefits.
I graduated from NMSU with a Bachelor of Arts Degree in Government in 2000.
Criminal defense is the art of representing a client against the government from allegations of criminal conduct.
The primary objective is to maintain the client's freedom.
When that objective cannot be accomplished, the objective shifts to minimizing the consequences of a criminal prosecution such as incarceration, fine, or loss of other constitutional rights and privileges, such as the right to vote or the right to keep and bear arms.
Since 2003, I have represented hundreds of clients in criminal defense cases at all levels of the New Mexico criminal justice system.
Family law representation is the art of representing the client involving what is the client's most intimate and personal area of life: the client's family.
These types of cases include divorce, child custody, child support, and adoptions.
Because the cases in this area of law involve the client's family, the parties are frequently emotional.
Unlike most other types of litigation which tend to focus on past events, like criminal or personal injury cases, family cases are typically "in progress" and can be very chaotic and stressful.
Personal injury and Civil Rights representation is the art of representing the client against institutions of power for wrongs done by those institutions or the people those institutions represent.
In the context of personal injury cases, the opponent is almost always an insured person's insurance company with stockholders, a profit motive, and little regard to the injuries sustained by the victim.
To the insurance company, the client is a statistic and a business decision.
The attorney's job is to gather evidence to establish legal liability of the defendant, to prove legal damages from the injuries, and to negotiate with the insurance company on the client's behalf.
