Estate Planning is the process of distributing a person's assets during life and after death.

The distribution of assets depends on whether or not the person died with a valid, existing Will.
If so, the person is said to have died testate and the estate will be administered and distributed according to the terms of the Will.
If the person died without a Will, they died intestate and the administration and asset distribution will be determined according to state statute.
It's important to know that often the intestate distribution is not what the person may have intended or wanted, but in the absence of a valid Will, the statutes govern.
