The first thing you need to know about driver's license restoration in Michigan is that the Secretary of State (SOS) is not trying to help you get your driver's license back.
I know this because I have been representing people in driver's license restoration cases since 1999 and have witnessed the many changes in driver's license restoration law and procedure.
The changes were not made to make it easier for you to have your license reinstated.
First: You need to actually be sober for at least one year and not be on probation or parole.
One of the more common ways that a Michigan DUI lawyer in Macomb, Oakland or Wayne county can help their client fight a drunk driving charge is by getting the charge lowered from OWI (Operating While Impaired) to OWVI (Operating While Visibly Impaired).
Michigan law recognizes Operating While Visibly Impaired as less severe, since it doesn't necessarily imply a bodily alcohol content.
Additionally, if your MI DUI lawyer gets your charge lowered to OWVI (Operating While Visibly Impaired), the penalty is still quite severe.
In 2010, the Michigan Legislature enacted a "get-tough" addition to the criminal code - The "Super Drunk" Law.
If you have recently been charged with a Michigan Super Drunk offense in Oakland, Macomb or Wayne county, you should immediately contact a qualified Michigan OWI lawyer to begin preparing to fight your charge.
A person who drives while intoxicated, impaired, or with the presence of any amount of a controlled substance is guilty of "child endangerment" if a child under the age of 16 years of age is a passenger in the vehicle.
Michigan Child Endangerment penalties are quite severe.
If you've be charged with a Michigan OWI Child Endangerment in Macomb, Oakland or Wayne county you need to contact J. Erich Goetz as-soon-as-possible to help you prepare a your defense against this serious charge.
