You must go with a private attorney because the public defenders to not handle the DMV case. If this is your 3rd misdemeanor offense in 10 years (out of state usually count), then be aware that you are exposed to significant jail time, 120 days is the legal minimum on a 3rd offense DUI and it's usually more than that in our local courts. That's not even counting any probation violations which can add additional time.

With a 1st offense, even in a regular non-commercial vehicle while not working, causes a 1 year loss of commercial driving privileges completely (no restricted commercial privilege) - you then have to re-apply for a brand new license, not just get it re-instated. With all of the above cases or even just a "standard DUI" it's very important to know the players involved (the prosecutors and what they like and don't like and the Judges to know their likes and dislikes) and the local policies.

Locally alternative sentencing techniques change between counties and even between courtrooms in a county.
Services
I get asked, because of my background, what are my favorite areas of the law - that is easy.
DUI - because it's challenging and you get to help non-criminals stuck in the criminal system, usually for just this one time.
Go with someone you feel you can work with - it really become a partnership when the attorney takes your case.
Go with someone that will answer your questions and not try to talk over you in order to impress you.
Go with someone that is willing to tell you the weaknesses with your situation and not "sell" you.
When it comes to the fees that your DUI attorney will charge you, you'll most likely find a whole range of options offered by the different lawyers on your list.
From flat fee to hourly rate, and the actual costs associated to both of those, the fees of a DUI attorney vary from lawyer to lawyer.
Because of that, it's best to speak to different lawyers that have different fee structures.
This is the only way to find out which fee structure is right for you.
The flat fees of different DUI lawyers range from lawyer to lawyer.
1. Can usually appear in court for you so you don't have to go (in misdemeanor cases) - If a felony you have to go to your court appearance - (my office regularly appears for people that are either from out of the area or don't want to do their public appearance in front of a judge).
2. Might be able to save your license (remember you only have 10 calendar days to request a DMV hearing to protect your right to drive) - my office has been doing DMV hearings and saving people's right to drive since 1997.
