The non-immigrant NAFTA Professional (TN) visa allows citizens of Canada and Mexico, as NAFTA professionals, to work in the United States in prearranged business activities for U.S. or foreign employers.
The TN non-immigrant classification permits qualified Canadian and Mexican citizens to seek temporary entry into the United States to engage in business activities at a professional level.
Among the types of professionals who are eligible to seek admission as TN non-immigrants are accountants, engineers, lawyers, pharmacists, scientists, and teachers.
Treaty Trader (E-1) and Treaty Investor (E-2) visas permit holders of E visas to reside in the United States to manage the trade or investments of a U.S. business (the "Enterprise") or, in certain cases, to provide essential skills to the Enterprise.
Holders of E visas must intend to depart the United States upon the termination of their E status.
Treaty visas are authorized on the basis of treaties of commerce and navigation between the United States and certain other countries.
A current trade treaty must be in effect between the treaty trader or treat investor's home country and the United States.
If you are a non-citizen, meaning that you are a legal permanent resident or have some sort of temporary non-immigrant visa, or if you are undocumented in the country, you could be subject to removal from the country.
The Immigration and Nationality Act (INA) defines the grounds of inadmissibility or removability.
Inadmissibility means you are not authorized to enter or remain in the United States.
Removability means you are authorized to be in the United States but have violated a section of INA that makes you subject to removal.
An applicant for naturalization must be a Legal Permanent Resident for at least five (5) years or three (3) years if that person obtained Residency through lawful marriage.
The applicant must also be able to demonstrate competency in the English language unless that person is over the age of the 50 and has been a Resident for a certain number of years.
The applicant must also pass U.S. government and civics written examination.
An applicant's criminal record, immigration history and other civil issues such as taxes and child support may lead to denial of naturalization.
