Welcome to the website of the Etowah County District Attorney's Office, Sixteenth Judicial Circuit, Etowah County, Alabama. This website is designed to introduce you to the office of the district attorney, Jody Willoughby, and assist the citizens of Etowah County in navigating through the legal justice system if they are the victims of crime, or a merchant in need of assistance with the collection of worthless check.

A number of specialized support units help in the administration of justice and protection of the rights of children, victims and witnesses. Our office is located on the ground floor of the Etowah County Judicial Building, 801 Forrest Avenue, Gadsden, AL 35901. The Pre Trial Diversion Program was created to focus on the rehabilitation for first-time, non-violent offenders by participating in various corrective programs.

This is the very first court appearance you will have and it is the process by which a person is brought before a court to hear and answer criminal charges against him or her.
Your personal presence is required.
If you are out of custody be on time no matter what.
Bail is determined, which may be different than the presumptive bail amount, or defendant may be released on his or her own recognizance.
A date for the defendant's next court appearance is set.
As discussed more in depth below, that next date may be a preliminary hearing if at least one of the charges is a felony, or a pretrial hearing if the charge if charges are misdemeanors only.

This is a free service to the citizens of Etowah County.
Writing a worthless check drawn on non-sufficient funds or closed accounts is a crime.
Our Check enforcement Unit can help you stop this theft and protect your business.
All worthless checks must be referred to the check unit within 9 months from the date of the check to insure proper processing if a warrant must be obtained.
The Etowah County District Attorney's Worthless Check Unit was formed to collect restitution for victims of worthless checks.
The unit assists businesses and individuals who receive insufficient funds and account closed checks.
The Worthless Check Unit is a self-funded service of the District Attorney's Office.
There is no charge to victims to use our service.
When the bad check writer fails to pay through our office, we assist with the prosecution.
If you are a victim of a worthless check, and you want the assistance of the District Attorney's Office, certain guidelines must be followed for a warrant to be issued.
The Pre Trial Diversion Program was created to focus on the rehabilitation for first-time, non-violent offenders by participating in various corrective programs.
To provide for the establishment of a pretrial diversion program in the 16th Judicial Circuit in Etowah County; to set basic operating standards for the program; and to provide for program fees and their distribution.
Admittance into the pretrial diversion program shall be in the sole discretion of the district attorney.
The district attorney may require the offender to submit to any test or evaluation process the district attorney deems appropriate in evaluating the offender for admittance into the pretrial diversion program.
