Nearly 1 in 10 elderly people will suffer abuse or neglect at the hands of another each year. Most victims of elder abuse are unable to protect their rights and cannot "fight back" against their abusers. Unfortunately, many families of elderly victims see things they know aren't right (they feel it in their gut), but most of the time they also do nothing.
This is due to fear, misinformation, intimidation, and a lack or resources. Doing this for 25 years we have learned that "behavior rewarded is behavior repeated", so we seek to hold wrongdoers accountable. While we are highly selective in the cases we take, we pride ourselves in taking the time to listen. Although all of our cases are "large" we analyze cases in a unique way, and some of our largest verdicts and settlements come in cases that other lawyers reject, and insurance companies or defendants minimize.
In fact, just three of our Ventura County trial verdicts (Arellano, Medina & Matthews) resulted in total verdicts of over $14.3 Million dollars, and in each case no offer was made before trial.

Assault is the intentional act of making someone fear that you will cause them harm.
You do not have to actually harm them to commit assault.
Threatening them verbally or pretending to hit them are both examples of assault that can occur in a nursing home.
Unfortunately, assault is common in long term care.
Overworked employees can develop "compassion fatigue" and actually start to resent the sick and vulnerable people under their care and act out aggressively instead of compassionately.
We've worked on dozens of cases involving assault in long term care, including sexual assault (by staff and other residents), physical assault (by staff and other residents), and psychological/verbal assault.

Bedsores, also known as "Decubitus Ulcers" or "Pressure Ulcers", are open sores resulting from prolonged pressure on the skin.
They are almost always a sign of neglect or abuse because they are literally caused by leaving someone in the bed for hours and hours at a time until the skin breaks down over a "bony prominence".
We commonly see them develop near the tailbone, ankles, hips, and heels, although we've seen them on ears, toes and everything in between.
Very often the facility will come up with an excuse to justify the development of a bedsore.

What is Elder Abuse?
Elder Abuse takes many forms.
It can be physical or psychological and it can happen instantly (like an assault) or very slowly, like the deprivation of food or water.
Just because a health care provider tells you something is "normal" or "part of the dying process" does not mean what you are seeing is not abuse.
Trust your gut.
What is Elder Neglect?
California's Elder Abuse and Dependent Adult Civil Protection Act prohibits, among other things, elder neglect by the parties whose responsibility it is to take care of an elderly person (age 65 or older) or dependent adult.
