My name is Samantha Berryessa.
I am a sixth generation Californian.
My paternal family history hails from northern California where we ranched raising horses and cattle, on a 36,000 acre land grant home.
My maternal family farmed sugar beets in Montana and before that, in the south.
Dax Cowart, my late husband was a Texas trial lawyer and former Vietnam Airforce Pilot.
His paternal side of the family were cattle ranchers and his mother's family were farmers.
Our marriage was enhanced by our mutual backgrounds and passion for the law.
Dax Cowart (born Donald Cowart) is an attorney noted for the ethical issues raised by efforts to sustain his life against his wishes, following an accident in which Cowart suffered severe and disabling burns over most of his body.
Cowart's case has become highly famous in the realm of medical ethics.
The land lay in a small valley and, unbeknownst to the Cowarts, a gas leak had caused the valley to become filled with propane gas.
After surveying the land, the Cowarts returned to their car, and the sparking of the ignition set the gas on the floor of the valley ablaze, severely burning both men.
So what does the law say?
The general rule is that all of us have a duty to exercise ordinary care which is just another way of saying that we are supposed to conduct ourselves reasonably under the circumstances.
We don't have to conduct ourselves perfectly, just reasonably.
And in a jury trial, what is reasonable under the circumstances is what the jury finds it to be, based on the facts and evidence presented and after following instructions on the law.
Every week, everyday people from all kinds of backgrounds and walks of life serve on our juries making their viewpoints known, arguing for what they believe is right and what they believe is wrong.

And if there happens to be a big lawsuit in the news you can bet it will get more than its share of being argued about with just about everyone being an authority on what the law is or what it should be.
