Irina S. Shea is a graduate of the Georgetown University School of Business and the Georgetown University Law Center and has been an estate planning attorney since 1996.
She is licensed to practice law in both New Jersey and New York.
She has worked as an associate attorney in the Trusts & Estates department of Skadden, Arps, Slate, Meagher and Flom in NYC doing high end estate planning and as a Vice President and Trust Officer at JP Morgan Private Bank in NYC.
These experiences gave her unique insights into not just strategic estate planning but the real life execution of such estate plans years later that prove invaluable to her private practice clients today.
If you're an elder without a spouse or children and you are living on your own, it's even more critical that you have a comprehensive estate plan naming trusted people to take care of you, your health care decisions, your finances, and your estate.
You may also be worried about your own incapacity and who would take care of you if you were not able to make decisions on your own.
Relying on friends and neighbors for such important decisions can be tricky.
Often, they are the same age as you.
You could rely on banks or trust companies to act as a Trustee or Executor for you but they will not be able to act for health care decisions or as Power of Attorney for you.
If you are an elder or an elder married couple with adult children and grandchildren, you want to make sure that your children inherit your assets smoothly and without the burdens of estate administration.
You may even want to leave their inheritance in a trust to protect it from divorce, business creditors, and other risks so that you know those funds will eventually reach your grandchildren.
We set up trusts for children that are both fair and flexible to give you peace of mind that your inheritance will last past one generation.
If you're in your forties, fifties, or sixties with young adult children you may be contemplating retirement, downsizing to an apartment, moving to a less expensive state, or helping your children with their first home purchase.
Your young adult children may not be financially mature enough to handle a large inheritance so a fair flexible trust for them may make sense.
For example, you may wish to name an independent trustee to manage investments and distributions for your adult child but then name your adult child as a co-Trustee at a certain age (for example, age 30) and then at a later age (for example, age 35) give that adult child the right to remove and replace their independent trustee acknowledging that their choices may be different than yours.
If you're in your twenties, thirties, or forties and married with young children under the age of 18, the most important thing you can do is name a guardian in your Will followed by trusts for your minor children.
This is one of the most difficult, yet important, decisions that a parent can make.
We can guide you on what the considerations are for naming an ideal guardian and trustee and create trusts until an age of financial maturity (for example, age 30) that will give you peace of mind that even if you were not here to raise your children that trusted loved ones would do so.
