When people come to an Elder Law attorney they often expect to talk about their estate plan.
However, Elder Law attorneys exist to work with your estate while you are living.
Yes, your estate and legacy planning are considered; Elder Law attorneys just start with what happens today rather than the day after you die.
Should you require assistance do you have any special desires or people you especially trust or distrust?
Isn't everyone an expert?
It certainly feels that way when you watch the various ads out there.
Most people believe estate planning is one of two things: a will or a way to get around taxes.
In reality, an estate plan (even a simple one) is much more than that.
It is your opportunity to express what you wish to have done with both your person and your property if you are sick, unavailable, or have passed away.
For some individuals a deed may accomplish their goal for others extensive trust agreements may be in order.
Speaking with an attorney allows you to discuss all your options.
Often people will put off planning their estate because of the amount of "legal talk" that they must endure.
Sadly many families have a family member who has medical or physical issue that requires assistance from the government.
For those who receive benefits the thought of losing the benefit is extremely frightening; likewise many parents are afraid they may cause their children to lose benefits through they estate plan.
Therefore they decide the best thing to do is to exclude them.
The fact is there are ways to help families leave a legacy behind for that person without causing them to lose their government benefits.
People will often come into the office with one goal.
AVOID PROBATE.
Others will come into the office afraid of what is about to happen because they have been told they need to go through Probate.
The truth is Probate Court in and of itself is not something to be feared.
Most problems in probate are a result of poor planning or poor communication between family members.
When families work together often probate is easier, cheaper and faster than even a Trust.
Probate is the process that takes an individual's assets and distributes them according to their Last Will & Testament.
