Once the business has been set up, there are a host of pitfalls every business has to navigate through.
Buying or selling a business takes time, but the process often unfolds in the following way: The purchaser finds a business for sale and wishes to due some financial due diligence about the business before making an offer.
Many people believe that estate planning is only for people who are particularly wealthy, have elaborate plans in mind for passing their money to their heirs, or for people who are acutely ill and contemplating their death.
This could not be farther from the truth!
Estate planning is for every husband, wife, mother, father, grandparent, business owner, professional, or anyone else who has someone they care about, are concerned about delegating responsibly for their own well being should they become disabled, are concerned about who will care for their minor children when they pass away, and for anyone who seeks to make a difference in the lives of others.
The reality is that many people will become disabled one or more times during their lifetime.
Should that occur, who will have the necessary legal authority to make medical decisions for you, or to access and manage your financial assets?
Absent key legal documents, very likely no one.
Should that occur, the only recourse available is to petition the court for the authority needed.
There are two types of authority the court is typically asked to grant when someone becomes disabled.
One is a petition to have someone appointed Guardian of the Person; the other is a petition to become Conservator (essentially a trustee) of the Assets.
Probate is a process by which the debts of a deceased person are identified and paid, and title to the remaining assets are distributed to the beneficiaries of the decedent's estate.
Some probate is a court-supervised process for distributing the individually owned assets of a deceased person to beneficiaries in accordance with the instructions written in the person's will, or if there is no will, then by the laws of intestate succession.
Other probate involves nothing more than filing some papers with the probate office.
A living trust or revocable trust is a legal document that, just like a will, contains your instructions for what you want to happen to your assets when you die.
But, unlike a will, a living trust can avoid probate at death, control all of your assets and prevent the court from controlling your assets if you become incapacitated.
Upon the death of a trust maker, called the grantor or trustor, our law firm offers legal services to your successor trustee.
The trustee is responsible for seeing that the assets of the trust are distributed properly and in a timely manner.
