Michelle Kaminsky joined Hite Kaminsky Family Law & Mediation, PLLC (formerly the Law Offices of Kelly S. Hite) in 2010, became a partner in 2015, and is now Managing Partner of the firm.
Prior to joining Law Offices of Kelly S. Hite, she served as a Law Clerk for the Honorable David S. Schell of the Fairfax County Circuit Court from 2009-2010.
Ms. Kaminsky practices family law in the Northern Virginia area and has extensive experience in assisting clients with divorce, child custody and visitation, child support, spousal support, equitable distribution, settlement negotiations, pre-marital agreements, enforcement issues and adoption.
Like mediation, collaborative law offers a non-adversarial way to resolve divorce cases.
It emphasizes mutual respect, honesty, candor, and the preservation of the dignity and well-being of not only the parties, but also the entire family.
The goal is to craft a creative and sustainable resolution that satisfies the important needs of both parties.
Unlike mediation, where the mediator meets with both parties but must remain neutral and cannot represent or advocate for either party, in the collaborative law approach the parties each retain their own attorney to advise them and advocate for them.
Litigation relies on the court system to resolve issues that could not otherwise be settled.
Through litigation, the parties rely on their respective attorneys to argue their cases in a trial before a judge who makes the ultimate decision in the matter.
While litigation is rarely the desired course of action due to its substantial emotional and financial costs, sometimes it is the best option.
When it is, we will vigorously pursue all legal remedies available to protect our client's interests.

Mediation offers a less adversarial approach to divorce.
In mediation, a neutral third party who is specially trained in negotiation, communication, and conflict-resolution facilitates the parties' settlement talks and helps them arrive at a resolution of their divorce and/or custody related issues.
This is a voluntary and confidential process that enables parties to take control of and craft their own settlement rather than having it be dictated by a court.
The mediator remains impartial and cannot provide legal advice, represent or advocate for either party.
