A divorce action can be filed by either party to end a valid marriage.
Whether you and your spouse jointly decide to divorce, or one spouse decides unilaterally to end the marriage, divorce is one of the most difficult things a person will endure.
There are three estates to be determined: The separate estate of the husband, the separate estate of the wife, and the community estate.
All property is presumed to be community property and subject to division: income received by the spouses and assets acquired with those monies are community property.

A SAPCR is an acronym for Suit Affecting Parent Child Relations.
These are suits involving a child when the parents were not married at the time the child is born.
The SAPCR will include all aspects of the parenting plan, including conservatorship, rights and duties, possession and access, child support, and health insurance.
The parents can be appointed Joint Managing Conservators, or one of the parties can be appointed a Sole Managing Conservator and the other a Possessory Conservator.
There is a presumption that the parents should be appointed Joint Managing Conservators.

Child Support: Child support can be established in a divorce or SAPCR proceeding.
The Texas Family Code has guidelines to establish child support.
Child support is based on many sources of income, including wages, salaries, bonuses, overtime, rental income, child support received for another child, interest income, etc. Child support is based on a calculated net income of gross earnings less social security, medicare, and withholding for single and one.
Union dues and the cost of insuring the child(ren) on a health insurance policy can also be deducted before applying the appropriate percentage.
