Mariellen M. Antonelli, the principal and founding attorney of Antonelli Family Law, LLC, has practiced law for over 23 years.
Since she entered private practice, she has worked exclusively in the area of domestic relations and family law, helping individuals start new lives and crafting fair and reasonable solutions in divorce, child custody, spousal support, parenting time, the equitable division of assets, child support and other family law cases.
Mariellen has developed a strong and diverse network of accountants, appraisers, business evaluators, psychologists, and other professionals to assist our clients when needed in the preparation and presentation of a client's case.
Under Ohio law in order to file for divorce, you and/or your spouse must have been a resident of the state of Ohio for at least the past six months and of the county in which one of you live for at least 90 days.
When a Complaint for Divorce has been filed, the Clerk of Courts will prepare a summons and the Defendant will be served with the Complaint for Divorce.
The Plaintiff is required to obtain proper service on their spouse.
There are a number of ways to serve a person but the most common are: personal service; the Sheriff's department; certified mail; and service by publication.
Child Support is monetary compensation from one parent of the child(ren) to the primary caregiver of the child(ren).
Child support is used to financially support the child(ren) and provide for the things that the child(ren) need.
The court will look to the best interests of the child as to ensuring that the arrangement is as fair as possible.
Remember that a paternity test is always required, if a parent wants to seek child support.
As part of the child support agreement, the parents may also designate the parent who will be responsible for providing medical insurance (if available to the parent and at a reasonable cost) for the child(ren).
Unlike child support, which by statute provides a table of income and a formula as to the calculation of the child support.
Spousal support on the other hand is not based on a formula.
The Trial Court has the sole discretion by considering the 19 factors outlined in the spousal support statute to award or not award spousal support.
When the Court makes an award of spousal support, a trial court is required to make an award which is both appropriate and reasonable based upon all of the facts and the facts and circumstances of the particular case.
When at all possible, I strive to resolve cases outside of a stressful courtroom setting.
Interest based resolution allows the parties to retain control of their case and make some of the most important and life changing decisions together.
I often utilize tactics such as negotiation, mediation and the collaborative process to navigate through many domestic cases.
The goal is to divide assets and debts equitably and assist my clients in moving forward confidently.
I believe that divorce does not have to be emotionally and financially destructive, a marriage can be terminated with the parties keeping their respect and dignity.
