Jana Ruth Barnett earned her bachelor's degree from Syracuse University (Phi Beta Kappa, magna cum laude, Honors Program) in 1973.
Three years later, Attorney Barnett earned her juris doctorate from the University of Maryland at Baltimore.
Attorney Barnett litigated civil and criminal cases in Baltimore, Maryland for seven (7) years.
At the same time, she earned a Masters of Administrative Science from the Johns Hopkins University.
Attorney Barnett left private practice to work in the Legal Division of Maryland Casualty Company, where her clients included the Human Resources Division.
Since becoming a sole practitioner, Ms. Barnett has utilized her problem-solving skills to help clients concerned with employment, family and business matters.
Her employment clients seek counsel on such issues as their eligibility for unemployment compensation, their rights to be protected from discrimination, their rights to be paid for all time worked at the appropriate rate, their rights to get access to their personnel files, and their rights to receive severance benefits.
They appreciate the practical advice which they receive about what needs to be done to protect their rights, and what damages are compensable.
The Court may award alimony to be paid upon divorce if, and only if, it concludes that alimony is necessary.
There are seventeen (17) factors which the court must consider when determining whether alimony is necessary and, if so, the nature, amount, duration and manner of payment of alimony.
The statute does not specify the weight to give these factors.
Alimony cannot be used to punish or reward the parties' behavior.
Rather, it is intended to ensure that an individual's reasonable needs are met if the person cannot support himself or herself through employment.
Where a divorce decree has been entered, the court may allow alimony, as it deems reasonable, to either party only if it finds that alimony is necessary.
The sources of income of both parties, but not limited to, medical, retirement, insurance or other benefits.
The contribution by one party to the education, training or increased earning power of the other party.
The extent to which the earning power, expenses or financial obligations of a party will be affected by reason of serving as the custodian of a minor child.
